1. Seller and scope

These terms govern sales made on www.txfturbo.fr by TXF, a French SAS with share capital of €200.00, 2-4 rue Frédéric Joliot Curie, 93270 Sevran, France, SIREN 921 271 656, 921 271 656 R.C.S. Bobigny, VAT FR91921271656 (“TXF”). Contact: contact@txfturbo.fr — +33 7 50 62 88 25.

They apply to consumers and business customers unless a clause expressly addresses one category. Consumers retain the mandatory protections of their EU country of residence.

2. Products and compatibility

TXF sells new and standard-exchange turbochargers. The condition, references, price and any refundable core charge are shown on the product page and in the basket.

Searches by registration number, vehicle, manufacturer reference or TecDoc data help identify a part but do not replace checking the references on the vehicle and removed turbo. The customer should compare those references or ask TXF before ordering. This does not limit TXF’s statutory obligations.

Photographs are illustrative. The characteristics and references displayed when the order is placed define the contractual product.

3. Orders, prices and payment

The customer can correct the basket and details before confirming an order carrying an obligation to pay. A sale is formed when TXF accepts it and sends confirmation on a durable medium. TXF may reject or cancel for a legitimate reason such as unavailability, an obvious pricing error, suspected fraud or payment failure; any amount collected is refunded.

Prices are in euros. Consumers see the tax-inclusive total, delivery charges and core charge before confirmation. VAT depends on destination and customer status. A business requesting an intra-EU exemption must supply a valid VAT number verified through VIES and meet the legal requirements.

Only methods offered at checkout are available. Stripe processes card payments; TXF does not receive the full card number. Unless stated otherwise, payment is due with the order. For business customers, no early-payment discount applies; statutory late-payment interest and the €40 recovery indemnity apply to overdue sums.

4. Delivery

The shop serves France, Germany, Belgium, the Netherlands and Spain. Available methods, charges and timeframes for the address are shown before payment. A carrier timeframe stated as running “after dispatch” does not include order preparation.

TXF delivers on the date or within the period promised. If none was agreed, delivery takes place without undue delay and no later than thirty days after the contract. Consumers retain their statutory remedies for delay.

For consumers, risk passes on physical possession. Customers should inspect the parcel and promptly report damage to TXF and the carrier, with photographs where possible. Failing to note a reservation with the carrier does not remove a consumer’s rights against TXF.

5. Refundable core charge and old-unit return

A standard-exchange turbocharger may carry a mandatory refundable core charge. Its product-specific amount is shown separately on the product page, basket, order and invoice and is collected with the order. A new product shown without a core charge requires no old-unit return.

To receive the refund, the customer returns an old turbo corresponding to or compatible with the ordered unit, complete, not dismantled and safely packed. Contact TXF first: TXF provides instructions and arranges return transport for the old unit. Shipping arranged without prior agreement does not automatically entitle the customer to reimbursement of that cost.

TXF checks identity, completeness and condition. A different or incompatible, incomplete, dismantled or inadequately packed unit damaged in transit may lead to a reasoned refusal. Once approved, TXF refunds the full charge by bank transfer without undue delay; bank details may be requested. Progress is shown in the order details.

The core-return process is separate from statutory withdrawal: one refunds the old-unit charge, while withdrawal concerns the purchased product.

6. Consumer withdrawal and returns

A consumer has fourteen calendar days from receipt to notify TXF of withdrawal without giving a reason. The form below or any unambiguous statement may be sent to contact@txfturbo.fr. Simply refusing the parcel is insufficient.

After requesting instructions, return the product within fourteen days of notification to TXF, 2-4 rue Frédéric Joliot Curie, 93270 Sevran, France. The consumer pays the direct return cost and must pack the product appropriately. Liability is limited to diminished value caused by handling beyond what is needed to establish the nature, characteristics and operation; fitting or using a turbo may cause substantial diminished value.

TXF refunds sums due, including the initial standard-delivery cost, within fourteen days of notice. It may wait until it recovers the goods or receives proof of dispatch. Refunds use the original payment method unless another no-cost method is expressly agreed. Extra cost for a more expensive original delivery option is not refunded.

This right is for consumers and does not apply to statutory exceptions, including goods made to the consumer’s specifications or clearly personalised. Selecting a standard reference compatible with a vehicle is not, by itself, personalisation.

7. Statutory guarantees

Consumers have two years from delivery to invoke the French statutory guarantee of conformity for a lack of conformity. It gives a right to repair or replacement within thirty days, free of charge and without major inconvenience.

A repaired product receives a six-month extension. If replacement is imposed after repair was requested, a new two-year period starts on replacement. Depending on the statutory conditions, the consumer may obtain a price reduction or terminate the sale for a refund.

Consumers also benefit from the French latent-defects guarantee under Civil Code articles 1641 to 1649 for two years from discovery, allowing a price reduction or full refund against return.

For a second-hand or reconditioned product, a defect appearing in the first twelve months is presumed to have existed at delivery; later, the consumer may have to prove it existed then. Misuse, incorrect fitting or a peripheral vehicle fault is not a turbo defect, but TXF assesses each claim without restricting statutory rights. Installation invoices or diagnostic evidence may be requested where relevant.

Any commercial guarantee stated on a product page is additional. Consumer-only rules do not apply to professional purchases; businesses retain rights including the statutory latent-defects guarantee.

8. Complaints, mediation and applicable law

Complaints should first be sent to contact@txfturbo.fr or the registered office, quoting the order reference.

Consumer mediation: as at the update date, TXF has not yet appointed a consumer mediator. The mediator’s name, address and website will be published here once the required agreement has been concluded. This does not limit amicable remedies or access to a competent court.

French law applies without removing mandatory, more protective rules in a consumer’s country of residence. Consumers may use the courts competent under applicable rules. Between businesses, the courts for TXF’s registered office have jurisdiction if an amicable solution fails, subject to mandatory law.

If one clause is unenforceable, the others remain effective. TXF retains orders and invoices for statutory periods; customers can access documents in their account or request a copy.

9. Model withdrawal form
